Preamble
These Terms of Service (hereinafter “ToS”) set out the rules and conditions applicable to the file transfer and sharing service (hereinafter “the Service”) provided by Netalis SAS (hereinafter “Netalis”), french company know as RCS Besançon 812 132 512.
By using the Service, the user (hereinafter “the User”) acknowledges having read and accepted, without reservation, all the provisions set out below.
The Service allows the temporary transfer and sharing of digital files. Files are hosted exclusively in France, on servers owned by Netalis, accessible only to duly authorized Netalis personnel.
Netalis acts solely as a technical hosting provider within the meaning of Article 6 of French Law No. 2004-575 on Confidence in the Digital Economy (LCEN).
The Service is available to any user with internet access.
The User agrees to use the Service only for transferring files that comply with applicable laws.
The User is solely responsible for the content of the files transmitted, as well as for the confidentiality and legality of the data shared.
The maximum size of files that can be sent through the Service is specified and displayed within the user interface. Any attempt to exceed this limit may result in transmission failure or automatic deletion of the file.
Files transferred are temporarily stored on Netalis servers.
They are retained for a limited period, clearly indicated within the Service interface.
After this retention period expires, files are permanently deleted, with no possibility of recovery.
Netalis does not provide long-term backups: the preservation of data remains the sole responsibility of the User.
Files are hosted in France, within secure data centers operated by Netalis.
Only authorized Netalis staff may access the infrastructure, strictly within the scope of their technical duties.
Netalis implements reasonable technical and organizational measures to protect the Service but cannot guarantee absolute security or the complete absence of risks (intrusion, interception, data loss, etc.).
In accordance with French law, Netalis may be required to disclose:
connection logs related to operations carried out through the Service,
and, if necessary, the files themselves,
only in response to a judicial request issued by a competent French court and duly verified.
The User is fully responsible for the content of the files they transmit and for their subsequent use.
Netalis cannot be held liable for:
the loss, deletion, alteration, or disclosure of files;
consequences of fraudulent or unlawful use of the Service by the User or third parties;
the temporary or permanent unavailability of the Service.
The User is solely responsible for keeping their own original files outside the Service.
Service availability depends on the technical resources deployed and may be temporarily interrupted for maintenance, updates, or incidents.
Netalis does not guarantee uninterrupted, continuous, or error-free access to the Service.
The maximum file size and retention period are defined by Netalis and may change over time.
Netalis reserves the right to amend these ToS at any time. Amendments will take effect upon their online publication. Continued use of the Service constitutes acceptance of the updated terms.
These ToS are governed by French law.
Any dispute regarding their interpretation or execution shall fall under the exclusive jurisdiction of French courts.
